Terms and Conditions

Welcome to E10 Media. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using https://e10media.com, you agree to be bound by these Terms.

1. Services Provided

E10 Media provides digital media services, including, but not limited to:

• Real estate photography and videography
• FAA Part 107 certified drone services
• Virtual staging and twilight conversions
• Visual editing and marketing content

All services are subject to availability, scheduling, weather conditions, and payment terms.

2. Intellectual Property & Licensing

All media produced by E10 Media, including photographs, videos, drone footage, edits, and designs, remains the sole property of E10 Media unless otherwise agreed in writing.

Upon full payment, clients are granted a limited, non-transferable license to use the media for marketing and promotional purposes related solely to the property or brand for which it was created.

Media may not be:

• Resold, sublicensed, or transferred to third parties
• Used for unrelated properties or projects
• Altered beyond standard cropping or resizing
• Submitted to vendors, builders, stagers, or other parties without written permission

Additional usage rights may be purchased upon request.

3. Client Responsibilities

Clients agree to:

• Provide accurate project details and full property access at the scheduled time
• Ensure the property is clean, staged, and photo-ready upon arrival
• Secure pets and ensure safe working conditions

E10 Media is not responsible for:

• Delays caused by property condition
• Restricted access or locked areas
• Weather limitations affecting drone operations
• Objects not removed prior to the shoot

Reshoots due to property readiness may incur additional fees.

4. Payment Terms

Payment is due in full upon delivery unless otherwise stated in a written agreement.

E10 Media reserves the right to:

• Withhold final media delivery until payment is received
• Charge late fees on unpaid balances
• Decline future bookings for overdue accounts

Accepted payment methods: Cash, Credit Card, ACH, HDPhotoHub Checkout

5. Cancellation & Rescheduling

We require a minimum of 24 hours' notice for cancellations or rescheduling.

Cancellations with less than 24 hours' notice may incur a cancellation fee of up to 50% of the scheduled service.

Weather-related rescheduling for drone services will be accommodated at no additional charge when necessary.

6. Turnaround Time

Standard turnaround is 24 to 48 hours, excluding weekends and holidays. While we strive to meet all deadlines, turnaround times are not guaranteed in cases of:

• Severe weather
• Equipment malfunction
• Force majeure
• High-volume booking periods

7. Drone Operations & Compliance

All drone operations are conducted in compliance with FAA Part 107 regulations.

Drone services may be restricted due to:

• Airspace limitations
• Temporary flight restrictions (TFRs)
• Weather conditions
• Safety concerns

E10 Media reserves the right to decline drone operations if conditions are unsafe or non-compliant.

8. Revisions & Editing

Reasonable revision requests must be submitted within 5 business days of delivery.

Excessive revisions, major alterations, or requests outside the original scope may incur additional fees.

Virtual staging edits are non-refundable once completed.

9. Limitation of Liability

All services are provided "as is."

E10 Media shall not be liable for:

• Loss of business, revenue, or anticipated sales
• MLS platform errors or third-party compression
• Platform-specific image distortion or cropping
• Weather-related visual limitations

Maximum liability, if any, shall not exceed the amount paid for the service in question.

10. Indemnification

Clients agree to indemnify and hold harmless E10 Media from any claims, damages, or legal disputes arising from:

• Unauthorized use of media
• Misrepresentation of property condition
• Copyright violations resulting from materials provided by the client

11. Third-Party Links

Our website may contain links to third-party services. E10 Media is not responsible for their content, policies, or practices.

12. Changes to These Terms

E10 Media reserves the right to modify these Terms at any time. Updates will be posted with a revised effective date. Continued use of services constitutes acceptance of those changes.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Tennessee.
